Planexa is a mobile application & web app that allows users to host and join events and games. By using Planexa, you agree to these terms.

2. User Responsibilities

As a user of Planexa, whether you are hosting or joining an event, you agree to abide by the following rules:

• Event Hosting (Individuals or a Company): You are responsible for ensuring that your event does not cause public disturbance, violate any laws, or include activities such as protests or any events that are not legally permitted.
• Event Attendance: You must comply with the rules and conditions set by the event host and Planexa. Failure to do so may result in the suspension or termination of your account or remove you from the event without a refund.
• Legality of Events: You must not host any events that are illegal, violates provincial and federal laws or violate any third-party rights. Planexa will not be responsible for any incidents caused by the host or participants.

3. Event Cancellations and Refunds

• Planexa is not responsible for any difficulties or issues caused by cancelled events.
• Events hosted on Planexa are not sponsored or hosted by Planexa unless specified.
• Tickets sold are non-refundable and non-transferable unless exceptions provided by the host.

4. Payment Terms

• Payment Processing: Payments are securely processed via Stripe. Planexa does not collect or store any payment information; this is handled by Stripe.
• Payment Transaction Fees & Platform Fees: Planexa charges a platform fee for each event booking, which is non-refundable. The amount of the platform fee is determined at Planexa's discretion. Always refer to the payment gateway (Stripe) to get more details about payment transaction fees.
• Payment Issues: The host controls the payment processing and disputes, Always contact the host for any payment related issues.

5. Third-Party Services

• Planexa integrates with Stripe to provide secure payment services. By using our platform, you agree to Stripe's terms and conditions.
• Planexa does not collect or store any payment details. All payment information is securely processed by Stripe.

6. Event and Host Accountability

• Host Responsibility: Event hosts are fully responsible for organizing and managing their events. Planexa cannot guarantee the success, quality, or legitimacy of the events.
• Event Issues: Planexa is not responsible for ensuring the smooth operation of the event. Users are advised to do their due diligence when choosing to attend an event.
• If Planexa observes activities such as hosting fake events or consistent cancellations, we will take necessary actions, which may include account suspension or termination.

7. Intellectual Property

• User-Generated Content: Planexa does not claim ownership of the content uploaded by users, including event descriptions, images, and other media. Users are solely responsible for the content they share.
• Prohibited Actions: Users may not reproduce, modify, distribute, or exploit any content from the Planexa platform without express permission from Planexa.

8. User-Generated Content and Reporting Violations

• Reporting: Users can report inappropriate behaviour or problematic events by submitting feedback through our website (www.planexa.ca) or emailing info@planexa.ca.
• Investigation and Action: Planexa will investigate all reported issues. Based on the findings, we may take necessary actions, including suspending or cancelling user accounts.

9. Dispute Resolution

• Disputes Between Users: Planexa encourages users to resolve disputes amicably. However, if necessary, Planexa may intervene and mediate disputes where possible.
• Arbitration and Mediation: Disputes between users and Planexa will be resolved through arbitration in accordance with Canadian laws. By using the platform, you agree to settle disputes via binding arbitration, and waive the right to pursue legal action in court.
• Jurisdiction: Any disputes that cannot be resolved through arbitration will fall under the exclusive jurisdiction of the courts in Nova Scotia, Canada

10. Account Suspension/Termination

• Planexa reserves the right to suspend or terminate accounts for violations of these Terms, including but not limited to:
  • Consistent event cancellations without valid reasons.
  • Inappropriate behaviour towards other users.
  • Hosting fake or misleading events.
  • Engaging in illegal activities through the platform.
• Appeal Process: If your account is suspended or terminated, you may contact us at info@planexa.ca to appeal the decision. Planexa will review appeals on a case-by-case basis.

11. Age Requirements

• Minimum Age: The host determines the age category for their events. The host is responsible to verify local rules and regulations before hosting any event.

12. Privacy and Data Handling

• Data Collection: Planexa collects personal information including, but not limited to, your name, email address, phone number, and location.
• Data Storage and Sharing: By using our platform, you consent to the collection and secure storage of your personal data, which may be used by the Company for promotional and marketing purposes, including sending you commercial electronic messages (CEMs) about our products, services, offers, upcoming events.

13. Changes to These Terms

Planexa reserves the right to modify these Terms at any time. Changes will be effective immediately upon posting within the app or on the website (www.planexa.ca). It is the responsibility of users to review the Terms periodically. Continued use of the platform after updates constitutes acceptance of the revised terms.
